Platform Role and Third-Party Charity Conduct
 

  • No Liability for Partner Conduct: Ōtautahi Community operates as a digital fundraising and storytelling framework to support local initiatives. While we are proud to champion these projects, the Ōtautahi Community Charitable Trust is a separate entity and is not liable or responsible for the actions, omissions, operational mismanagement, misconduct, or financial deployment of any beneficiary charity or community group once funds have been distributed.

  • Vetting and Due Diligence: We take appropriate, reasonable steps to verify that recipient charities are legitimate and, where applicable, registered with Charities Services (Ngā Ratonga Whakamaamaa). However, donors acknowledge that ultimate operational accountability lies solely with the recipient organisation.
     

Information Accuracy and Content Disclaimers
 

  • Errors and Inaccuracies: We strive to showcase local community projects authentically. However, the information, stories, metrics, and data published on our website, social media channels, and within our Impact Reports are provided "as is." Ōtautahi Community is not liable for any inaccuracies, typographical errors, omissions, or misstatements regarding the projects or data featured.

  • Unannounced Updates: To ensure our content remains relevant and accurate, we reserve the right to modify, update, correct, or delete any content on our website, social media feeds, or official documentation at any time without prior notification.
     

Limitation of Liability
 
To the maximum extent permitted under New Zealand law, the Ōtautahi Community Charitable Trust, its trustees, staff, and partners shall not be liable for any direct, indirect, incidental, or consequential loss, damages, or expenses arising out of:
 

  • Your use of, or inability to use, our digital donation platform.

  • Any reliance placed on the information published on our website or social media channels.

  • Any technical interruptions, system downtime, or transactional payment failures.
     

Governing Law
 
These terms, along with your use of the Ōtautahi Community platform, are governed by and construed in accordance with the laws of New Zealand. Any disputes arising out of these terms will be subject to the exclusive jurisdiction of the New Zealand courts.
